NOTE:
Diplomatic immunity is a principle of international law that exempts foreign government officials and their families from the criminal, civil, and administrative jurisdiction of their host country.
The Vienna Convention: Modern diplomatic immunity is primarily governed by the 1961 Vienna Convention on Diplomatic Relations, which has been ratified by nearly all nations.
Not Personal Exemption: Immunity belongs to the sending state rather than the individual diplomat; its goal is smooth state-to-state communication.
Who is Covered?
• Diplomatic Agents: Ambassadors and high-ranking staff receive full criminal immunity and inviolability (cannot be arrested or detained).
• Family Members: Immediate family members living with diplomatic agents often enjoy the same broad protections.
• Administrative and Technical Staff: Receive protections tied largely to their official duties.
• Consular Officers: Generally have immunity limited strictly to official acts performed in the line of duty.
• Inviolable Spaces: Embassy buildings, residences, and diplomatic bags cannot be searched or entered by host-country police without permission.
Limitations and Enforcement
• Duty to Obey Laws: Diplomats are still legally required to respect local laws and avoid interfering in the internal affairs of the host country.
• Waiver of Immunity: The sending country can choose to waive a diplomat's immunity, allowing the host country to prosecute them.
• Persona Non Grata: If a diplomat breaks the law or misbehaves, the host country can declare them persona non grata (unwelcome), forcing the sending state to recall them or expel them, typically within 48 hours to a week.
• Civil Exceptions: Civil and administrative immunity usually does not cover private real estate, personal successions, or outside commercial/professional activities.
